The following Privacy Policy Statement (the “Privacy Statement”) details the privacy practices of Green Light Ventures LLC, d/b/a Prismana Inc. (hereafter, “Prismana,” “we,” or “our”) and describes how we may use and not use information we receive from you or obtain via prismana.com, prismanaservices.com, or prismanasystems.`com (the “Sites,” or, individually as for any of the listed websites, a “Site”) in the providing of the Services as defined and described below in this Statement.  By using our Sites, you understand and consent to the collection, storage, processing, and transfer of your information to our facilities in the United States and those third parties with whom we share it as described in this policy.

Your Consent

By using any of the Sites and Services (defined below), or by providing us with your personally identifiable information, you acknowledge and consent to the terms contained in this Privacy Statement. If you do not agree to the terms contained herein, including having your information (“Personal Information” as defined below) stored by us and/or used in any of the ways described in this Privacy Statement, do not provide us with your information. However, understand that if you do not provide us with your information, you may not be able to use some or all of the Services or the Sites. You further agree that you may not withdraw your consent with regard to already-obtained information.

Updates and Notice of Material Change in the Use of Your Personal Information

This Privacy Statement may be altered by us, from time-to-time, in our sole discretion. Though we reserve the right to alter this Privacy Statement at any time, we will notify you of any changes within (30) business days of the change taking effect, unless such a change is made in exigent circumstances, in which case we will do our best to notify you of the change with as much time as possible. It is solely your responsibility to review this Privacy Statement each time you use the Sites and Services, in case there have been any changes made to it.  Failure of us to notify you, or of you to read, any such changes to this Privacy Statement shall in no case exclude you from such provisions.  Your use of the Sites or Services following any changes or modifications to this Privacy Statement constitutes your full acceptance of and agreement to the modified Privacy Statement. In the event of a material change to the way we use your Personal Information, we will notify you of such change and ask you to affirmatively accept such changes.  In such instance, you may be prevented from accessing or utilizing the Sites or Services unless you accept such change(s).

This Privacy Statement applies to all of Prismana’s Services and its websites. This Privacy Statement is incorporated in its entirety into Prismana’s Terms and Conditions of Use (hereinafter “Terms of Use”), which may be found at https://prismana.com/terms-and-conditions/, and which Terms of Use shall apply at all times to your use of the Sites and Services.

Description of Our Services

We offer our business customers a web-based interface dynamic information insertion system for measuring marketing campaigns, improving customer service, and improving sales performance. Our application offers channel information for inbound potential customer leads, as well as software maintenance and upgrades and customer support, that enable our business customers to track the performance of their marketing efforts (the “Services”).

Collection of Personal Information

As a part of the Services Prismana provides, Prismana collects the information about the users that visit our business customers on their websites. We collect this information on client website visitors via our JavaScript code. This information includes, but is not limited to, IP address, User Agent, URLs visited on our client’s website, and other data that may be accessible through the JavaScript code installed on the client’s website. Additionally, we use various in-house and third-party tools to analyze the activity of our potential and current clients as they use our website and our Services.

When you register for Services on any of our Sites, we collect your Personal Information, including but not limited to your name, company name, phone number, email, and postal address. For payment purposes, we also collect billing information but we do not store any of your billing information.  Billing information is stored by a PCI-compliant third party billing company.  The third party storing the information may change, but shall always be PCI-compliant and shall provide a privacy policy which you may access on their website.

We may also use Personal Information you provide when you visit our Sites or become a registered user of the Products or Services, or we may use your Personal Information to contact you to further discuss the Products and Services that we provide, and to send you information regarding Prismana, such as promotions, contests and events.  Site Visitors and registered users are invited to receive emails from Prismana, such as promotions, contests, newsletters, or events (collectively, “Promotional Information”).

Data Retention and Destruction

Information collected is retained by Prismana indefinitely and available to our client for as long as they remain a client in good standing. If a client cancels their account (or is terminated for any reason), we make no guarantee that their data will remain if they wish to return later. A data sunset policy will likely be implemented in the future, but does not exist today and we cannot guarantee that data is fully scrubbed from all backups and snapshots.

Disclosures and Transfers of Personal Information

We do not share your Personal Information with third parties, except when one or more of the following occurs:

  • When such disclosure is necessary for the purpose for which the Personal Information was obtained, or for the performance of the Services;
  • When such disclosure is permitted by applicable law;
  • When you have given us with your permission to make such disclosure;
  • When we are disclosing your information to our credit card service provider in order to process payment for Services as requested by you;
  • When such Personal Information is otherwise publicly known or available in accordance with the applicable law;
  • When such disclosure is made in relation to marketing for Prismana, or, with your authorization, for the marketing of third parties;
  • When such a disclosure is to a third party business for the purpose of assisting Prismana in maintaining our Sites and/or Services, or providing marketing assistance, or providing data analysis (“Administrative Service Providers”), including Administrative Service Providers that may be outside the country or jurisdiction in which you reside;
  • When such disclosure is reasonably necessary in the event of a sale of our business or its assets;
  • When such disclosure is made to an entity that controls, is controlled by, or is under common control with Prismana;
  • When Prismana, in our sole discretion, deems such disclosure to be necessary with regard to any legal claim or claims, or for the sake of compliance with, or to satisfy any law, regulation, subpoena or government request, or if such disclosure is made in connection with litigation; or
  • When such disclosure is made as a result of Prismana’s actual belief or suspicion, whether reasonable or not, that our user(s) is or are engaged in illegal activities or is or are otherwise in violation of our , whether or not a subpoena, warrant or court order has been issued in such case(s).

Opting Out in the United States

You may opt out of being sent Promotional Information by us at any time by sending an email to support@prismana.com. Separately, you may ask to sign up for to receive Promotional Information when registering for the Services or by emailing support@prismana.com.

Except as noted above, your email address will not be distributed or shared with third parties, and you can opt out of receiving Promotional Information by emailing support@prismana.com at the time it is distributed, or at the time any individual registers for the Service.

If at any time you desire not to receive Promotional Information from us, email us a request to opt out of receiving Promotion Information at support@prismana.com.

Opting In for Canadian Customers

Your email address will not be shared with any third parties, and you may opt out of receiving any communication at any time by emailing support@prismana.com.

California Resident’s Privacy Rights

Under the law of the State of California, California residents may opt-out of disclosure of their personal information about them to third parties for those third parties’ own marketing purposes. To opt out of such disclosure for such purposes, you may contact us by emailing support@prismana.com and making the request. Residents of California additionally have the right to request from businesses with whom they have an established business relationship the types of personal information such business shares with third parties for direct marketing purposes by that third party, as well as to which third parties the business has shared such personal information within the preceding calendar year. To request this information from us, you may contact us by emailing support@prismana.com, and we will respond within 30 days, as required by Section 1798.83 of the California Civil Code.

Additionally, California law requires us to disclose to you how we respond to your browser’s “do not track” signals or other tools that allow you to designate what personally identifiable information is shared about your past online activities on other web sites or online services. Per California law, we are also required to disclose whether third parties may collect personally identifiable information about your past online activities on different web sites when you use our Sites. Please see the following section on Third Party Advertising and Tracking section below for information on this topic for your review and understanding.

Third Party Advertising and Tracking

Data about your online activities is collected on our Sites to provide you with advertising tailored to your interests. We may enlist network advertisers and ad exchanges to show you advertisements from all over the internet.  We may also use third party data analyzing services to tell us about the viewing of ads and content on our Sites as well as how these ads are used on third party web sites.  Other sites may give you a choice as to whether to allow your information collected for the above purposes.  This section will tell you more about third party advertising and tracking, and how to limit it.  You may see ads on third party websites after visiting our Sites, because we participate in third party advertising networks that look at your activities online and collect information about your online activities through automation.  This may include the use of technologies described in the section titled “Do Not Track.”  These advertising networks use your past online activities to display ads that cater to your individual interests. Additionally, these tracking technologies can be set to prevent you from seeing the same ads too often, or to help you understand how the ads you see are useful.  The information collected by these advertising networks includes your activities on our Sites, such as the pages you have viewed on our Sites.

You understand that technologies associated with our Sites may . We will not specifically sanction any such activities, but such activities may be out of Prismana’s control.

The collection of your data and targeting of ads to you takes place on our Sites and on other third party websites also in the ad network, including websites that feature the advertisements displayed by the network.  This can also help us see whether our marketing is effective.  We will use commercially reasonable efforts to protect your Personal Information, pursuant to the relevant laws. We use a combination of first-party and third-party cookies, much like Google does, to see how your ad usage and impressions, as well as your interactions with these ad services and impressions, relate to visits to our Sites.

Cookies are used to collect, retain, maintain and report user behavior. Prismana as well as third party technologies use cookies on all devices used to access websites utilizing Prismana. We do not control any third-party tracking technologies, including those that use our technology to help collect or store information that they use. As such, this privacy statement and any other information we may provide on our privacy practices do not apply to these third-party advertisers or pertain to how they may collect or use any information they obtain from you. However, where possible, we do work with third parties to provide you with information on their practices, including how you may choose to limit what they do with your information.

In order to understand any third party’s practices with regard to the collection, storage, or sharing of your information, it is incumbent upon you to review any such party’s terms of use, privacy statements, notices, permissions, or options. You understand that we are not disclosing or making any statements regarding the substance of any policies or practices of third party advertisers or advertising networks, or any parties related to them herein. Though it may not relate to all companies we use to provide ads on our Sites, you may find information on choices available to you regarding advertising, including “opt-out” procedures, at http://optout.networkadvertising.org/ and http://optout.aboutads.info/, which deal only with members of the Network Advertising Initiative (“NAI”) and Digital Advertising Alliance (“DAA”), respectively. You understand that if you choose to opt out of receiving targeted content and/or ads from an NAI or DAA member, that will only pertain to those members, and you may still receive targeted content and/or ads, on our Sites or elsewhere, through other networks or companies not bound by NAI or DAA rules. Additionally, you understand that by rejecting cookies when you visit the NAI or DAA op-out page, or by subsequently erasing your cookies, or using a different device or browser, your opt-out setting may no longer work and you may receive unwanted content and/or ads.  Please check your browser settings and the NAI and DAA links above.  Prismana will not be responsible for the effectiveness of or compliance with any third-parties’ opt-out options.

Our Sites may link to other websites. Prismana is not responsible for any information you input on any such websites, or their privacy practices or content. You will be solely responsible for reading and understanding the privacy policies or terms of use of any of these others websites.

Do-Not-Track is a public-private initiative through which end-users can activate a signal in their browser to notify websites that they don’t want to be tracked by third parties (see their website at http://www.w3.org/2011/tracking-protection/). However, because Do-Not-Track has not reached a consensus as to what these third-party websites should do when receiving such a notification, Prismana will not look at your browser’s Do-Not-Track setting, and will not change our activities as a result of your browser settings.

Correcting & Updating Your Information

To update billing information or discontinue the service, log into the website and access your account. Prismana will respond to your correction or update request within at most 30 days from the date of your request.

Confidentiality and Security

We maintain numerous safeguards to protect your information gained from our Sites.  We do not allow anybody to access your information other than our employees, any affiliates’ employees, or others to whom it is necessary to disclose such information to provide our services you in the course of conducting normal business operations. We make sure all Prismana employees know about their responsibility to keep your information and customer data secure and protected, and we inform them of all guidelines related to our Company’s business ethics standards and keeping your information confidential.

Prismana uses various physical, electronic, and procedural measures to protect its websites, and prevent unauthorized access to visitor and customer information. However, despite all these measures, it is not possible to guarantee 100% security of this information, and there will always be a chance that our efforts to safeguard your information will be ineffective.

Children’s Privacy

It is against Prismana’s policies that the Site and Services be used by individuals below the age of thirteen. As such, we do not purposefully collect any Personal Information about children below thirteen years of age. If it becomes known to us that we have collected Personal Information from a child below the age of thirteen, we will take all commercially reasonable steps to remove such Personal Information from our database.

If you are the parent or guardian of a child below the age of thirteen who has provided us with their own Personal Information, please contact us at support@prismana.com so we can use best efforts to delete such Personal Information from our databases.

Social Media Platforms and Websites

Any information of any type that you input into (including, without limitation, on all Prismana websites and Prismana social media pages, such as on Twitter or Facebook) is considered herein a “Submission.”  You acknowledge and agree that all Submissions are made without any expectation of privacy.  You make such submissions at your own risk. Prismana will not be responsible for the actions of any users on the aforementioned social media platforms and websites, or any others, and will therefore not be liable for anything that happens as a result of you making such a Submission. By visiting our Sites and social media pages, you represent and warrant to Prismana that you understand our Privacy Policy and Terms of Use, as well as the policies of all applicable social media platforms, and will operate consistently with the provisions contained therein.

It is possible that at some point we may offer an interactive or social feature (such as a web forum or message board where you can share messages, content, or other information with other Prismana users) that is directly administered by Prismana (a “Social Area”).  In such instance, we will make efforts to protect these Social Areas.  However, you understand that we cannot ensure the privacy or protection of any information you have posted on Prismana’s Social Areas, and you acknowledge that we are not responsible for anything that happens as a result of you posting such information.  You further understand and agree that you use any such Social Areas at your own risk, and that it is incumbent upon you to protect your own information and be cautious about what you provide therein.  Please note that these Social Areas may include the option to post your submissions publicly. Any information you submit on these Social Areas may be taken or used by other users.

Visiting our Site from Outside of the United States

All of our applications, websites and database servers are located in the United States. Some files may be stored across multiple servers. Please be aware that any information you submit on our Sites may be transferred to, and maintained on, computers or servers located outside of your state, province/territory, or country, where the privacy laws may differ from where you live. We will use reasonable efforts, within the applicable laws, to protect your Personal Information, but we cannot guarantee that the security measures where your information is stored will be as protective as those where you live. If you live or access our Sites from outside the US, and you choose to submit your Personal Information on our Sites, be aware that we may transfer this information to the US and process it and store it in the US. As a result, please understand that your Personal Information may be subject to requests from government, court, and law enforcement officials, as well as national security authorities within the US, pursuant to its laws. By submitting your Personal Information to us, you hereby expressly consent to your data being sent to, processed within, and stored in the US.  It is your responsibility to familiarize yourself with all relevant US laws and jurisdictional laws related to your Personal Information.
